Can Sex Abuse Victims Seek Compensation from Their Abusers?

Can Sex Abuse Victims Seek Compensation from Their Abusers?

If you have been sexually abused, you may be wondering whether you can hold your abuser financially accountable in civil court. Hopefully, all sexual predators will be caught and sent to prison, but criminal punishment for the perpetrator doesn’t always allow the victim to put his or her life back together. Knowing the abuser is behind bars certainly makes victims feel safer and gives them a sense of justice, but the victims’ lives are often still in shambles after being sexually abused. Victims of sexual abuse may struggle for years to find a sense of normalcy. Part of the problem is...

Offshore Injury Claims Are Handled Differently from Workers Comp Claims

Offshore Injury Claims Are Handled Differently from Workers Comp Claims

If you work in or around navigable waters, then you may be familiar with the Jones Act and the Longshore and Harbor Workers’ Compensation Act, both of which provide compensation to injured maritime workers while they’re recovering from their injuries. Laws That Protect Maritime Employees The Jones Act protects those who work on a vessel or offshore. These workers are often referred to as seamen. In addition to seamen, the Longshore and Harbor Workers’ Compensation Act protects those who work on land but near the water or on vessels that aren’t considered in navigation. Examples of these kinds of workers are below: ...

Liberative Prescriptions and Louisiana Law

Liberative Prescriptions and Louisiana Law

If you’re considering a civil suit in Louisiana, it’s important to be aware of limits in the law. For most legal action, the plaintiff only has a limited time to initiate a lawsuit. This restriction is called liberative prescription, and it functions something like the statute of limitations in other states. It’s also important to understand that the liberative prescription for most civil suits is very short—only one year—which is why it’s critical that you consult with an attorney immediately and act quickly to preserve your right to collect damages when someone has caused harm to you. Statute of Limitations or Liberative...

Things to Know About Medical Malpractice

Things to Know About Medical Malpractice

The first time most people give any thought to what medical malpractice is and how it’s handled under the law is when they find themselves facing a situation where pursuing a medical malpractice claim might be appropriate. Some medical malpractice concerns can be complicated, but understanding the basics isn’t difficult. What Is Medical Malpractice? If a person suffers an injury or illness because of the actions or inactions of a medical provider, it may qualify as medical malpractice. That covers a lot of ground, but there are two basic ideas to keep in mind: Did a medical practitioner cause the injury or...

Recovering Compensation After a Single-Car Crash

When you think of the car accidents involved in personal injury cases, you probably picture a reckless driver slamming into an unsuspecting motorist and causing injuries and property damage. Many of the cases we handle involve situations just like that, but not every car accident injury claim has to involve two or more vehicles. Unfortunately, most people involved in single-car crashes assume they can’t pursue compensation for their damages. If no one else was involved in the crash, no one else can be held responsible, right? In certain situations, that’s not exactly true. You might be able to hold one of several...

What Is an Injury Worth?

Being in the business of personal injury law, the attorneys at our firm are asked one question over and over: What is my personal injury worth? There’s no simple answer because every situation is different. You can’t say every broken leg is worth the same amount or every injury from a car crash is always worth more than every dog bite. It’s also difficult to answer because this is really the wrong question. Personal injury damage amounts aren’t determined by what an injury is “worth.” Instead, they’re calculated by taking many different factors into account to determine the reasonable value to...

Blood samples were taken to test the drivers for impairment, but the results have not yet been released. The second vehicle in the race has not been identified, and police are still hoping...

The Five Most Dangerous Roads in Baton Rouge

We all know how crazy traffic can get in our city. It’s an unfortunate truth, but even the most cautious of drivers can get into an accident thanks to the negligence of others—especially when trying to traverse one of our many dangerous intersections. According to a 2016 study, Baton Rouge ranked as the second most dangerous city for drivers just behind Detroit. Although other cities had more crashes, Baton Rouge’s much smaller size yielded the highest number of deadly accidents per capita: 16.6 per 100,000. Worst Areas for Driving The encouraging news is that for years the city has tried to cope with...

Drunk Driver Injures Twenty-Eight at Endymion Mardi Gras Parade

The biggest parade of the New Orleans Mardi Gras season was tragically interrupted late last month when a pickup truck crashed into a crowd of onlookers. The crash injured twenty-eight spectators, including a police officer at the scene and a small child. Most of the injured were hurt seriously enough to be taken to area hospitals, and five people were admitted in critical condition. On a positive note, no one was killed in the incident, and none of the injured had life-threatening injuries. Charges Issued The twenty-five-year-old driver of the pickup was not hurt in the crash and was arrested at the...
